Suspension of Fundamental Rights as Human Rights in India
Suspension of Fundamental Rights: -
The Law relating to Human Rights & Enforcement system is for all but subjecting to some relevant& justified exceptions under Indian Laws. In this connection, the enforcement of fundamental rights as mentioned under Part –III may be suspended during emergency (ies) by order of the President of India but except the articles 20 & 21 and all procedures which are pending in any Court for the enforcement of the rights as contained aforesaid shall also be suspended during the period of emergency (ies) or such shorter period as may be specified in the order. The provisions of article 19 shall also be suspended during emergency (ies), the article 358 reveals so especially for the article 19.
